You should annually review the assets in your trust. If the assets are not titled in the name of the trust, the assets are not a trust asset and you need to immediately title the asset in the trust to obtain the trust benefits. For example, if the asset is not titled in the name of the trust, the asset will not avoid probate. You may also want to consider whether there are additional assets you may want to transfer to the trust. For example, if you have acquired real estate or made new investments during the year, you may want to transfer them into the trust to avoid probate and protect the asset.
